CAN-SPAM ruling update
Use of whois privacy services may constitute "material falsification" of headers

In late October, the 9th Circuit Court of Appeals ruled that using whois privacy services - which in effect provide a "proxy" registration and allow domain registrants to conceal their identity - may constitute "material falsification" of headers under CAN-SPAM.
While no BlueHornet-owned domains make use of these services, it may not be advisable to make use of these services on your From or Reply-to domains. Although using whois privacy on a From or Reply-to domain is not likely to be prosecutable on its own, when present it may be easier for the FTC or attorneys general to establish intent to send unlawful messages if they become aware of other compliance issues involving your email - in essence, increasing the likelihood of having successful action pursued against you under CAN-SPAM.

Earlier this year, we notified you about the anti-spam bill which was introduced to Canada's parliament - known as C-27 or the ECPA (Electronic Commerce Protection Act).
Recap of major provisions which pertain to email marketing:
- Prohibits sending of unsolicited commercial electronic messages
- Prohibits collection of electronic addresses without consent
- Prohibits false/misleading representations online
Over the past few months, there was rising concern that proposed amendments would significantly change the scope of the final law.
As of October 27, 2009, the bill has passed committee review intact, and none of the proposed amendments were made.
This doesn't necessarily mean the current version is final. With the C-27 bill in its third review by the House of Commons, it's looking likely that the opt-in requirement will make it into law. At the moment it appears the ECPA is on track to be passed by the end of 2009.
The bill includes a grandfather provision which allows marketers to continue to contact recipients with whom they have an existing business relationship for up to 2 years after adoption of the law.
